These Terms of Service (“Terms”) apply when you visit, browse, buy, send, or redeem digital gift certificates on GiftCertificates.com.ph (the “Platform”). By creating an account or completing a purchase, you agree to these Terms.
1. Who we are
GiftCertificates.com.ph operates a marketplace technology platform. Each gift certificate is issued by the named merchant partner, not by the Platform as a retailer of prepaid cash. Purchase funds are collected through the merchant’s connected payment gateway (currently Webpay) and settle to that merchant.
2. Accounts
- You must provide accurate contact details so certificates and receipts can be delivered.
- You are responsible for activity under your login, including devices used for multi-factor authentication.
- We may suspend an account that we reasonably believe is used for fraud, abuse, or unauthorized access.
3. Gift certificates
- Each listing shows the merchant, face value (and net value, which matches the amount you pay), validity, benefits, and conditions of use.
- Paid certificates never expire, in line with Republic Act No. 10962 (the Gift Check Act of 2017) and its implementing rules, except where the law allows a different treatment (for example certain promotional instruments).
- Certificates are redeemable only with the issuing merchant and at locations described on the product or merchant page, subject to that merchant’s house rules and availability.
- Unless required by law, certificates are not refundable and are not convertible to cash.
4. Orders and payment
When you checkout, you authorize the merchant’s payment provider to charge the order total. A certificate is issued only after payment is confirmed as paid. Until then the order may remain pending or be cancelled if payment fails or expires.
Promotional or pricing errors may be corrected before issuance. If we cannot fulfill an order after payment, we will coordinate a refund through the original payment method where possible.
5. Delivery and gifting
Digital certificates are delivered by email and, when a mobile number is provided, SMS. You may keep a certificate in your account or send it to a recipient. You are responsible for the accuracy of recipient details. Lost, stolen, or forwarded certificates that have already been redeemed cannot be replaced.
6. Redemption
The holder presents the secure QR or reference at redemption. Merchants may require valid identification consistent with their policies. Partial redemptions, if offered, reduce the remaining balance. The Platform does not guarantee table availability, booking slots, or inventory at the merchant.
7. Merchants
Merchant partners remain the issuer. They are responsible for honoring valid certificates, staff training, branch operations, and their own consumer-facing policies, except where the Platform’s technology or these Terms assign a specific duty to us.
8. Acceptable use
You may not scrape the catalog in a way that degrades service, reverse-engineer issuance or QR security, attempt unauthorized redemptions, or use the Platform for money laundering or other unlawful activity.
9. Liability
To the fullest extent permitted by Philippine law, the Platform is not liable for merchant service quality, wait times, or experiences at the venue. Our aggregate liability arising from the Platform itself is limited to the amount you paid for the affected order, except in cases of fraud or willful misconduct, or where a limitation is not allowed.
10. Changes
We may update these Terms. The “Last updated” date will change, and continued use after notice constitutes acceptance of the revised Terms for new purchases.
